TERMS & CONDITIONS

Interest and claims in the company:

The customer/client/individual will not have any right, title, interest or claim on any of the assets or Proprietary information belonging to the Company and shall never initiate any action to claim a share in the same.

Intellectual Property: The customer/client/individual will not copy, alter, amend, add to, or deface the Trademark or the trademark of the company.

Indemnity: The associate channel partners/health service providers shall indemnify and continue to hold the company and its directors, employees and associates indemnified against all claims made by any third party or customer/client/individual and any related damages and expenses including the legal expenses arising out of or connected to the conduct of the associate channel partner which are not made by the company in writing. The liability of the associate channel partners/health service providers arising from this clause shall continue regardless of whether the action bought by such third party actually succeeds or not.

Disclaimer: Company hereby expressly disclaims any liability towards any harm, damage, prejudice or suffering to any customer/client/individual or his/her beneficiary caused due to any negligence on the part of one or more doctors or auxiliary staff employed by the channel partners/health service providers. Although the company shall endeavor to provide the best medical service to customer/client/individual, it makes no warranties expressed or implied regarding the services provided by the said delivery partner.

The company shall not be responsible in case communication is not received by the customer/client/individual due to incomplete address given by the individual.

"We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time"

Other Terms and Conditions

The Company will act as facilitator for conducting the health checkups.

The company will act as a SPOC for reports; however it will be the sole responsibility of the customer/client/individual for the same.

The Company will not be liable for any, loss, misinterpretation, discrepancy, or medico legal negligence in the medical health reports and the customer/client/individual indemnifies the company and its directors, employees and associates for the same.

The health checkups will be done on appointment basis only.

The customer/client/individual will not visit the affiliated health service providers directly, until a confirmation mail is sent by the Company for the same.The appointments will be fixed by the Company once the payments are reflected in the Company account. The appointment will be scheduled not before 3 working days after the payments being reflected in the Company account.

Tests in the package are conducted as a screening procedure for screening purpose and cannot be customized.
The package cannot be split between two or more people.
The package cannot be split between two or more people.
Some tests are centre dependant; tests may vary from centre to centre.
Some tests may not be conducted if the person receiving the tests reports with any contra indications medical or otherwise.
Certain Checkup will not be done for pregnant women /nursing mothers.
QD holds right to decline health appointment of client.

These terms may be changed from time to time and without further notice. Your continued use of the Site after any such changes constitutes your acceptance of the new terms. If you do not agree to abide by these or any future terms, please do not use the Site or download materials from it.

Qualitas Diagnostics may terminate, change, suspend or discontinue any aspect of the Site, including the availability of any features, at any time. Qualitas Diagnostics may remove, modify or otherwise change any content, including that of third parties, on or from this Site. Qualitas Diagnostics may impose limits on certain features and services or restrict your access to parts or all of the Site without notice or liability. Qualitas Diagnostics may terminate your use of the Site at any time in its sole discretion.

These terms apply exclusively to your access to and use of the Site and do not alter the terms or conditions of any other agreement you may have with Qualitas Diagnostics or its parents, subsidiaries or affiliates.

1. Proprietary Rights

Software :- Any software, including any files, images generated by the software, code, and data accompanying the software (collectively, "Software"), used or accessible through this Site may be used by you solely for accessing and using this Site for purposes expressly stated on the Site, provided that such uses are not competitive with or derogatory to Qualitas Diagnostics. Qualitas Diagnostics retains full and complete title to and all intellectual property rights in the Software. You agree not to copy, distribute, sell, modify, decompile, reverse engineer, disassemble or create derivative works from any Software.

2. User Conduct - General

In using this Site, you agree:

not to disrupt or interfere with the security of, or otherwise abuse, the Site, or any services, system resources, accounts, servers or networks connected to or accessible through the Site or affiliated or linked Web sites;
not to disrupt or interfere with any other user's enjoyment of the Site or affiliated or linked Web sites
not to upload, post, or otherwise transmit through or on this Site any viruses or other harmful, disruptive or destructive files
not to use or attempt to use another's account, service or system without authorization from GE, or create or use a false identity on this Site
not to transmit through or on this Site spam, chain letters, junk mail or any other type of unsolicited mass email to people or entities who have not agreed to be part of such mailings; f. not to divulge your username and password to others either on or off the Site
not to attempt to obtain unauthorized access to the Site or portions of the Site which are restricted from general access; and
not use this Site to seek, provide or obtain specific medical advice, medical opinion, diagnosis or treatment as applied to a patients particular condition or situation

In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted under your account, and that you will comply with all applicable local, state, national and international laws and regulations

3. User Conduct - Online Communities and Other Interactive Areas

The Site contains areas where you may post and share comments with other Site users on a variety of subjects. You agree that you will not post or otherwise disseminate on or through the Site unlawful, harassing, libelous, tortious, abusive, offensive, threatening, or obscene communications or material of any kind, or materials which infringe or violate any third party's copyright, trademark, trade secret, privacy or other proprietary or property right, or that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation; or, that are otherwise objectionable, including without limitation, content that evidences bigotry, racism, sexism, or hatred, or that promotes illegal activities, including without limitation unauthorized uses of medical devices, or physical harm against anyone. Qualitas Diagnostics reserves the right but not the obligation to remove any materials it deems objectionable, in its sole discretion and without any reference to you. You agree to hold harmless Qualitas Diagnostics and its affiliates and parties with whom Qualitas Diagnostics has contracted for purposes of hosting or maintaining this Site from all claims based upon communications made or materials posted by others or the use by third parties of this Site.

Conditions of Reporting:

a) In case of samples which are collected and referred to the labs; it is presumed that the patient demographics are verified at the point of generation of the said specimen.

b) The test requested might not be performed for medical reasons of the sample being unsuitable such as insufficient quantity/ Haemolysed/Clotted/Lipemic etc. For such cases a fresh specimen would be required to be provided by the concerned individual.QDC will endeavor to ensure that such errors and delay are minimized.

c) The reports which dispatched may vary to the time, place, and person and have to be co-related clinically by medical personnel’s respectively.
